It is a crime to advertise that you are either looking for a surrogate, or you are willing to act as a surrogate yourself. 2. It is illegal to pay or receive money for the actual act of surrogacy. Altruistic surrogacy or free surrogacy is allowed. 3. It is illegal to broker a commercial surrogacy arrangement. In addition, commercial surrogacy agreements are not enforceable in English courts, meaning that any surrogacy contracts created are not legally binding and there is no written agreement to for everyone to follow. That is a big mistake and injustice in my opinion. No one has legal protection or representation or any written contract. In most cases, the courts have ruled in for intended parents seeking to uphold a surrogacy arrangement. But, the well-being of the child will always take precedence. It's totally up to the judge so don't assume anything. Surrogacy in England isn't an easy task. Fertility clinics are not allowed to find a surrogate mother for you. There are, however, unregulated organizations in the United Kingdom that can offer surrogacy assistance. The Infertility Network UK is one of the best places to find out more. Do know-it-all legislators think they are god or is their bloated socialized medicine too broke to take on any added expense? Recently, local courts have ruled that the law was a taking of provincial (states) rights. It's a big mess. People forced to sneak around like drug dealers plus lie to their doctor and gynecologist. Prohibition never works. Not for booze or babies. Gay Surrogacy? Infertility rates rate are hitting 20%. Another 10% of the population is LGBT (lesbian, gay, bisexual, transgender). Why are both these countries making some 30% percent of their citizens potential criminals? Having progeny is a strong driving force. Isn't it? Personally, it gripes me to see socialistic countries telling their people what to do. Those with money can find a surrogate mother in another country. Can't they? Both England and Canada have socialized medicine. Long lines, long waits, rules and restriction (forms of rationing) are common. Better to have freedom and free enterprise. The US national healthcare act (ObamaCare) will lead to the same loss of liberty. The socialist bill will set up a 15 member panel to ration health care. Two judges have already ruled ObamaCare unconstitutional. This is TYRANNY and further evidence the Obama administration has no respect for the American Constitution! Many English, Canadian, French, German, Japanese, in fact most countries citizens seeking to have a baby by surrogate mother, rely on California commercial surrogacy. There are no laws against or banning surrogacy here in California.
