SURROGACY IN CANADA HAS PROHIBITION PROBLEMS

Why? Why do they want to control their citizen’s free market choices? Is it the Money? Is it socialism gone too far? Is it rising socialized medicine costs making Canada stressed out about paying the additional bill for new babies desired by infertile, lesbian and gay people? It looks to me like the socialist elite painted themselves into a corner on this surrogacy issue. Prohibition seldom works - for booze or babies.

Commercial surrogacy in Canada was prohibited with the passage in 2004 of the Assisted Human Reproduction Act. Altruistic surrogacy or free surrogacy (just pay expenses) is still allowed. Even though the act carries a fine of $500,000 and up to 10 years in jail, it has not eliminated paid surrogacy and egg/sperm donation. It has only driven the practices underground and made criminals of some 20% of Canadian citizens when you count the LGBT community and the 14% with infertility problems.

A March 12, 2010 article in Canada’s NATIONAL POST by Kathryn Blaze Carlson was titled, Baby by stealth: Reproduction law forcing 'dangerous alternatives.' The article then said, "Some onlookers fear that the legislation has created a secretive black market, where couples seek sperm and egg donors on Craigslist or in university libraries."

Then the article went on to say, "Where lesbian couples lie to doctors about their sexual orientation to avoid paying to quarantine a friend's sperm for six months. And where doctors and counselors sometimes adopt the credo of "Don't ask, Don't tell." It also said, "The act...has triggered condemnation from the right and left and was the focal point of an International Women's conference in Toronto last week. There, at the Law Society of Upper Canada, panelists argued that some of the legislation does more to imperil and confuse prospective parents and their offspring than it does to protect them."

Infertility now affects close to 14% of the world population and it's growing. This is driving those with the affliction to try various kinds of assisted reproductive technologies (ART) to have a child. This includes gestational surrogacy where there is no genetic link to the intended parents, as they are called. With traditional surrogacy at least one and sometimes both of the parents contribute genes. Anyway, I imagine it's tough to find someone to be a surrogate for free as the 2004 Act requires.

A disturbing article back on June 20, 2005 in BBC News written by Michelle Roberts led with the title, 'Infertility time bomb' warning. A professor Bill Ledger from Sheffield University in England warned then that infertility could rise to one out of three (33%) in Europe. It seems chlamydia, a sexually transmitted disease that carries risk of infertility has doubled over the last decade. In addition, six percent of girls under the age of 19 are classified as obese. Professor Ledger added, "The obese child is almost certain to become an obese adult. Many women who are overweight will not ovulate as efficiently." Also, regarding women putting off having a family, he said, "Women are simply not as fertile after 35."

As to surrogacy in Canada, the 2004 governing laws on surrogacy can cause people to break the law and quietly compensate cost of egg and sperm donors and cost of surrogate mother in cash only like a drug deal. By banning surrogacy in Canada: (1) There can be no written contract protecting the parties. (2) There is no attorney to watch over the agreement and handle the distribution of the money. (3) There is no psychologist to make sure the woman and other people involved are emotionally stable. (4) There is no commercial surrogacy agency to expedite the match and handle all the many details involved. (5) Non-profit organizations that deal with infertility in respect to paid surrogacy have their hands tied.

In 2008, a Quebec Court of Appeals ruled that the part of the act relating to fertility should actually fall under provincial jurisdiction and is therefore unconstitutional. The case made it to their Supreme Court in 2009, but they have not released any decision after sitting on it for over a year now.

Same sex marriage is now legalized. In addition, most provinces allow adoption to those doing same sex parenting. Remarkably, some provinces allow the lesbian moms significant other to be listed as the child's second parent on the birth certificate (according to the article in the NATIONAL POST).

Surrogacy in Canada with its' criminal sanctions on citizens is forcing people to do dangerous or expensive alternatives. Infertile couples along with lesbian mothers and gay men wanting to do same sex parenting are getting desperate.

Dear Delwyn Lounsbury, Thank you for your article about surrogacy in Canada. The problem is exactly as you wrote. My wife and I got stuck in Ukraine with new born baby from gestational surrogacy. We are Canadian citizens and former Ukrainians. 16 years we spent to have a baby, 12 attempts in Ontario , 3 in Ukraine. Finally we have wonderful baby - girl! Already 8 months old.

Canada requires DNA test . We refused. Who cares if mistake done in clinic and sudenly not my sperm fertilized. We are not going to give up on our daughter. Canada does not let baby in without DNA prof of genetic link. My wife ended with severe depression - loosing everything-house, job! We even have Ukrainian court decision that baby is ours and we can go to Canada. Have Birth certificate.

Desperate, do not know what to do next. That is the way Canada cares about their honest citizens, I never asked a penny from government, worked. Where to write and what to do we do not know. Any advice is apreciated. Thank you !!!
