Given society's general bias against gay surrogacy and lesbian surrogacy things are a lot better these days. The notion can get complicated. There are even feminists against surrogacy. Still, commercial gay surrogacy provides a very real option if done correctly. Lesbian moms who want to have children and may have infertility issues are equally welcome

You just don't know the background and history of the adopted child like you would in a surrogate pregnancy. "You get what you pay for," rules here. Surrogacy statistics show that it has become a very popular choice for same sex parents struggling with infertility. Regarding gay surrogacy and lesbian mother surrogacy it is something of a lifeline, providing in some cases the only real option for having a child. Thanks to advances in technology like IVF and in vitro fertilization the success rate of surrogate pregnancy has steadily increased. That doesn't mean that going this route is without its risks. Commercial surrogacy can carry a heavy weight, physically, psychologically and emotionally for all involved. It is the job of commercial surrogacy agencies to make it go as smooth as possible with no loose ends.
For a gay surrogacy, this can be particularly true. While surrogacy can occur with the use of the surrogate mothers own eggs along with the gay mans sperm, there is necessarily only one partner at a time who can be biologically connected to the child. This can lead to emotional upheaval for the remaining partner. Also, no matter how well you know the person that is to become a surrogate mother, there can be issues of attachment when a woman has carried and delivered a child. Remarkably, surrogacy statistics show only less than one percent of California gestational surrogacy births have surrogacy issues.
Gays surrogacy also can have the additional burden of the partner without a biological tie to the child being cut off from custody should the couple split up. This has been the case in many states, where laws on surrogacy favor the biological parent. Many states, and Israel, by the way, only allow types of surrogacy with heterosexual married couples. For all of these reasons, it is particularly important for the couples to be extremely careful when entering into a gay surrogacy.
It is always recommended that any person or couple opting for gay surrogacy to get an agreement in writing. This will spell out everything that all parties are agreeing to and make provisions for any eventuality. It will cover from how payments will be made to who's insurance is the surrogate healthcare provider, to how legal decisions will be handled and other information about surrogate parenting.
Of course, it is equally important to have proper medical and psychological screening of any potential woman interested in becoming a surrogate mother. This is where egg donation and surrogacy agencies ensure that the pregnancy goes as smoothly as possible. Many people think they can avoid the emotional and legal pitfalls and cost of surrogacy by choosing a free surrogate whom they know personally, or even a family member (altruistic surrogacy). While the surrogate may be willing to make this ultimate sacrifice, it is still important for all parties involved to have proper counseling, a surrogate healthcare provider, psychological testing and an attorney versed in laws on surrogacy. These are not readily available commercially in Canada due to the 2004 Human Reproduction Act they passed making it a $500,000 fine and 10 years in jail offence to pay for a surrogate mother, egg donor or sperm donor.
Altruistic surrogacy or free surrogacy is still allowed there.
Unfortunately, gay surrogacy means a tougher struggle than most to have a child and to raise a child in this society. When done properly it can be well worth it. Family has many different definitions and with the increased viability of gay surrogacy you should not be hesitant to go for it. Do your surrogate motherhood research. The effort may seem mighty, but the rewards are invaluable.
Here in California there are no laws on banning or against surrogacy. Those interested in gay surrogacy should be aware that a 1993 California gestational surrogacy court case (Johnson v. Calvert) awarded the intended parents all rights to a surrogate born child.
In 2005 the California Supreme Court decided three cases together that had to do with lesbian couples who had reproduced using surrogacy. The court ruled under the Uniform Parentage Act, two women can be the legal parents of a child produced through surrogacy. This ruling presumably applies to the rest of the LGBT community. Since these court rulings are now case law, this makes California the land of opportunity for infertile people around the world plus gay surrogacy, lesbian surrogacy and same sex parenting.
CNN and Reporter Soledad O'Brien plan to air a documentary "Gary and Tony Have a Baby" on June 24, 25, 26 & 27 of 2010. CNN explains as follows:
"Unable to legally marry in the U.S., (Gary and Tony) travel to Canada, get married, and spend thousands on an arduous journey toward parenthood via surrogacy and in vitro fertilization. ... Though Gary and Tony had hoped for a happy extended family, they discover instead ambivalence about same-sex-marriage. With court battles and struggles against their hometown community, can these men achieve a life as mainstream as their parents?"

Warning - Surrogacy in Canada has turned dangerous. If you pay for an egg or sperm donor or surrogate mother you are subject to
a $500,000 fine and 10 years in jail. Altruistic or free surrogacy is still allowed and you can pay all birthing costs and normal surrogate expenses. With some 14 per cent of people worldwide infertile, and say 6 per cent LGBT, just for instance, this means 20% or so of their population has a prohibition problem.
Canada just made same sex marriage legal. There is a demand for gay surrogacy. Why are they making it so hard for their infertile and gay/lesbian citizens to have a child? Is it that they can't afford any more costs and expenses added to their already overloaded socialized medicine program? Is this what the U.S. has to look forward to? Talk about rationing. Stupid is as government does.
