Voices sounding against surrogacy have been growing in volume over the years. It seems for every positive point, there is a negative and some of those against surrogacy can be profound. While intended parents desperate to have children will reach for literally any possibility they can find, they really should take a long hard look at the pros (for) and (cons) against surrogacy issues before they go the route to surrogate motherhood. Many wonder is commercial surrogacy ethical. Is it baby selling, pre-birth childcare, wombs for rent, baby business, the exploiting of poor women by the rich, outsourced pregnancies or “baby farms.” Well. How would you feel if you were infertile and couldn't have children? There is a need for a fertility surrogate and actually very few surrogate contracts ever evolve into a dispute.

Commercial surrogacy is actually one of the most expensive alternatives for infertile couples. Since the couple themselves take on all the cost of egg donation IVF (in vitro fertilization) surrogacy, as well as the cost of hiring and finding a surrogate mother which may also involve paying a fee to a commercial surrogacy agency for them to find a surrogate mother, the cost can easily become a real issue.
Other surrogacy issues are that you may also need to hire an attorney proficient in laws on surrogacy and a psychologist and the costs can increase even more. Although adoption is cheaper, we feel that "You Get What You Pay For" comes into play. You just don't know where the adopted child came from or who were the child’s real parents. It's the long term possible costs that can be the problem. I was struck by Marie Osmand's tragedy in February of 2010 when her adopted son committed suicide. You have no control and the child is not biologically related to you. Your family bloodline is not carried on which is one of the main benefits of surrogacy. "You get what you pay for". With these types of surrogacy you have control of the origin of your child. Control requires investment.
Along with mounting costs, which can be upwards of $60,000, there are also considerable legal and emotional facts about surrogacy. The entire process can be physically and emotionally taxing on the intended parents as they struggle with a surrogate pregnancy. Bringing that third person into that mix can just multiply the difficulties. So, be sure to do your surrogate motherhood research.
Since the intended parents are footing the bill, they usually like to maintain some control over the surrogate pregnancy itself, especially if their own egg and sperm have been used for the fertilization. Not all surrogates take kindly to this kind of overwhelming control and it can lead to arguments and hard feelings. This is why we recommend you pay the $100 or so per month for attendance at a surrogacy support group.
Of course, the single biggest argument against surrogacy is the
very real possibility that the surrogate mother may have second thoughts and decide to keep the child she has carried to term and delivered. This can cause a tremendous amount of anguish on all sides, not to mention potentially leading to a long and messy legal battle. And if the surrogate's own egg was used for fertilization, she may actually have a legal right to the child, muddying the waters even more. Be sure to get a surrogacy contract agreement signed by all parties. Surrogacy statistics show only less than one percent of people have had surrogacy issues.
There are no laws on banning or against surrogacy here in California. A 1993 California gestational surrogacy court case
(Johnson v. Calvert) awarded intended parents all rights to the child born to a surrogate mother and subsequent cases have good courts acceptance. There was also a 1998 case, (Buzzanca v Buzzanca), in which neither of the intended parents had any genetic link (it was the surrogate mother's egg and an anonymous sperm donor). The court ruled that the intended parents were the lawful parents of the child.
Some people may believe that they can sidestep this kind of emotional baggage by using a relative or friend for surrogate parenting (altruistic surrogacy), but that idea isn't without its potential problems too. While it is one way of finding a surrogate mother, she may still bristle at the thought of someone else taking control of her surrogate pregnancy or might still change her mind and that could lead to family discord. Actually, less than one per cent of surrogacy mother arrangements have surrogacy issues.
No matter how well intentioned they may be, intended parents will find that the path through surrogate parenting can be challenging. Considering all of the possible factors that argue against surrogacy, it may be wiser to consider either other infertility treatments or adoption. Again we actually feel that although cheaper adoption has too many unknowns, no control and the child is not related to you.
Nothing is more hopeful and joyful than bringing a life into the world, but in the case of surrogate motherhood it can also be difficult and emotionally taxing. Whatever your circumstances, be sure to consider all of the options arguments against surrogacy are being overtaken by increases in infertility, now 14% of the population Some reports expect 33% infertility due to a rise in Chlamydia a sexually transmitted disease and an increase in obesity. Both can lead to infertility.
